Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation plastic cover by which the dead body was covered has been recovered at the apointing out of the applicant. There is no other evidence against the applicant. The applicant is not having any criminal intecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Juman involved in case crime no. 496 of 2005 under Sections 302,201,404 I.P.C., P.S. Bithor District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
