Heard learned counsel for the applicant and the learned A.G.A. and Sri Naresh Kumar, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation one witness stated that prior the alleged occurrence the applicant has stated tha he will teach a lesson to the father of the deceased. The statement was recorded on 20.10.2006 and on 21.10.2006 the statement of Shatrughan Sengar and Ranvir Sengar was recorded. According to their statement the other co-accused made extra judicial confession before them and on1.11.2006 at the pointing out of the applicant one blood stained banka was recovered. The recovery was made from an open place. There is no direct eye witness account. The applicant has been falsely implicated on the basis of doubt and suspicion.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Lotan alias Anil Kumar involved in case crime no. 352 of 2006 under Sections 302 I.P.C., P.S. Auraiya District Auraiya be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
