Heard learned counsel for the applicant and perused the application under section 482 Cr.P.C.
The application under section 482 Cr.P.C. reveals that the applicant has filed this application challenging the proceedings of complaint case under section 138, Negotiable Instruments Act. However, he has not filed copy of the summoning order passed in the case and it has no where been asserted in the application that any summoning order has been passed against the accused applicant.
The learned counsel for the applicant submitted that a Police Constable had come to him with a non-bailable warrant issued against him. However this fact has not been asserted either in the application or in the affidavit filed in support of it.
Th learned counsel for the applicant prays for time to file supplementary affidavit. He is allowed 6 days' time for this purpose.
