We have heard Sri A.C. Srivastava, learned counsel for the appellants Dharamveer and Jitendra and learned AGA
We have gone through the impugned judgment as well as the record of the trial court including the post mortem report and statements of the eye witnesses Kuldeep and Surjeet.
Admittedly the first prayer for bail was rejected by a Division Bench of this Court on 2.1.2006. It is further admitted that appellant no. 1 is brother-in-law of the deceased Satish and appellant no. 2 is the son of appellant no. 1 and they are said to have killed Satish who was married to Urmila sister of Sharmili and appellant no. 1. According to the learned counsel for the appellants Sharmili disappeared from the house and appellants suspected the hand of the deceased in her elopement. The appellants with the help of two others are said to have killed Satish near Railway station. The appellant no. 1 used country made pistol and fired single shot at neck. Jitendra used knife and caused three incised wounds on the chest and other vital part of the body. Since the rejection of first prayer for bail no new ground has been made except that one-year back the prayer for bail was rejected. In view of the role assigned to the present two appellants, we see no ground to enlarge the appellants on bail.
We, therefore, reject the second prayer for bail.
