Heard learned counsel for the parties.

The petitioner by means of present writ petition has challenged the order dated 14th August 2006 passed by the Board of Revenue which in fact is a remand order whereby the order passed by the subordinate court dated 4th May 1984 has been set aside and the trial court namely the Naib Tahsildar before whom mutation proceedings are pending has been directed to decide the matter after affording opportunity to both the parties. This being a remand order in mutation proceedings I do not find this to be a fit case for interference at this stage. This writ petition is, therefore, dismissed.
