This is the second bail application moved on behalf of the applicant Pramod indicted in case crime No. 78 of 2005 under section 302 I.P.C. P.S. Malawan District Etah.
Heard Shri Onkar Nath , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the witnesses named in the First Information Report including the informant have not supported the prosecution case in their testimony before the court.
I have taken into consideration the submissions advanced on behalf of both the parties.
The witnesses namely Saheb Singh, Sher Singh, Veerpal Singh and Ram Naresh P.W. 1 to P.W. 4 having not supported the prosecution case in the trial, I consider it to be a fit case for bail.
Let the applicant Pramod indicted in case crime No. 78 of 2005 under section 302 I.P.C. P.S. Malawan District Etah , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
