Heard learned Counsel for the applicant, learned A.G.A. and Sri Rahul Chaturvedi learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. According to the F.I.R. the role of causing firearm injury is assigned to co-accused Deepak Verma, whose bail application has been rejected by this court. According to the post mortem examination report the deceased has received only one injury, but during investigation it is said that after committing the murder of the deceased co-accused Deepak Verma fled away by the motorcycle driven by the applicant. The case of the applicant is distinguishable with the case of co-accused Deepak Verma.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rahul involved in Case Crime No. 290 of 2006, under Section 302 I.P.C., Police Station Kotwali District Mathura be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
