Smt. Urmila Devi v. State Of U.P. And Others - APPLICATION U/s 482 No. 16762 of 2006  RD-AH 21247 (15 December 2006)
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the application under section 482 Cr.P.C.
The application under section 482 Cr.P.C. has been moved by the applicant for quashing the charge sheet, Annexure-3 to the affidavit filed in support of this application. A perusal of the charge sheet reveals that Arun Prakash, accused, who is husband of the applicant has been charge sheeted under sections 420, 494, 498-A, 506 I.P.C. and ¾ of the Dowry Prohibition Act. The allegation against the applicant, who is wife of Arun Prakash accused, is under section 506 I.P.C. only. The impugned charge sheet has been submitted on the application of Smt. Manju, who has alleged that Arun Prakash, accused, has performed his second marriage with her in the life time of his first wife, Smt. Urmila, the present applicant.
Notice on behalf of the State of U.P. has been accepted by the learned A.G.A.
Issue notice to O.Ps. no. 2 and 3.
Meanwhile, proceedings of the case no. 5078 of 2003 pending in the court of the Chief Judicial Magistrate, J.P. Nagar shall remain stayed against the applicant only till the next date of listing and this order shall not have any effect upon the proceedings of the case against main accused, Arun Prakash.
