Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the role of firing is assigned to the applicant and one other co-accused persons but according to the post mortem Examination report the deceased has received one gun shot wound of entry. There is cross version of the alleged incident. In the cross F.I.R. three persons have received injury on the applicant side. The injury received by the applicant side have not been explained by the prosecution. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Tulsi involved in case crime no. 275 of 2006 underSections147,148,149,302,336,323,504 I.P.C., P.S. Kasganj District Etah be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
