It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. and no looted property has been recovered from his possession. He has not been put up for identification. The name of the applicant has been disclosed by other co-accused persons.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Rais involved in case crime no. 28 of 2006, under Sections 302, 394 and 412 I.P.C., P.S. Math District Mathura be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
