Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation in the statement of the co-accused Dinesh the name of the applicant came to light. It is said that on the pointing out of the applicant a chain cover of the cycle f the deceased has been recovered. The recovery is not supported by any independent witness. There is no eye witness account. The co-accused Dineh Kumar Tiwari has been released on bail by this court on 13.12.2006 in criminal misc. bail application no. 27426 of 2006
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Sharavan Kumar Tiwari involved in case crime no. 393 of 2006 under Sections 302,201 I.P.C., P.S. Obra District Sonbhadra be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
