Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed by the co-accused Mukesh. The naming of the applicant is after thought. There is no direct eye witness account against the applicant. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out. The co-accused Rajveer Sharma whose case was on the same footing as the applicant has been released on bail by this court on 3.10.2006 in criminal misc. bail application No. 13318 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Shyam Kumar Sharma involved in case crime no. 45 of 2006 under Sections 302,201 I.P.C., P.S. Simbhawali District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
