Heard learned counsel for the applicant , the learned A.G.A. and Sri Amit Daga learned counsel for the complainant.
It is submitted by learned counsel for the applicant that according to the prosecution version the only evidence of last seen has been collected against the applicant and there is no direct eye witness account and nothing incriminating has been recovered from the possession of the applicant. There was no motive for the applicant to commit the alleged offence.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ajit alias Jitu involved in case crime no. 82 of 2006, under Section 302 I.P.C. P.S. Jhinjhana District Muzaffar Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
