This appeal has been filed by Chandra Shekhar @ Kallu Yadav, Ravindra @ Sookha Yadav and Mantoo against the judgement and order dated 12.12.2006 passed by Special Judge, SC/ST Act, Etawah in S. T. Nos. 341 of 2002 and 246 of 2003 whereby the appellants have been found guilty and convicted under Sections 323, 324/34 IPC and Section 3(1)(10) SC/ST Act and have been sentenced to undergo rigorous imprisonment up to four years and fine has also been imposed on them with default stipulation.
Heard learned counsel for the appellants, learned A.G.A. and perused the impugned judgement.
Learned counsel for the appellants has contended that learned Trial Court has not properly appreciated the evidence on record and has erred in convicting the appellants. He has also contended that it was a cross case and two persons on the side of the accused received injuries. However, cross case has resulted in acquittal.
In the circumstances of the case, appellants be released on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. They shall also deposit half of the amount of fine as imposed on them and the balance half amount of fine shall remain stayed during pendency of the appeal.
