Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by the learned counsel for the applicant that there is cross version of the alleged occurrence. Fro both the sides F.I.Rs. have been registered and both the sides received injuries. From the side of the prosecution one person has lost his life and 4 persons have received injuries. From the side of the applicant four persons received injuries, which have not been explained. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Chhotay Lal involved in case crime no. 232 of 2006, under Sections 304, 323, 504 I.P.C., P.S. Soraon District Allahabad be released on bail on his furnishing a personal bond and two sureties to the satisfaction of the Court concerned.
