This is an application for bail moved on behalf of the applicant Girjesh Rai indicted in case crime No. 86 of 2006 under sections 323, 325, 326, 504, 506 and 120-B I.P.C. P.S. Sikandarpur District Ballia.
Heard Shri Kameshwar Singh, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant is said to have opened fire at injured Abhay Rai. The learned counsel pointed out that the firearm injury is of simple nature and only one radio opaque shadow was found in the right side of the chest.
The learned A.G.A. submitted that specific role of opening fire has been assigned to the applicant and the firearm injury is on the vital part of the body.
I have taken into consideration the submissions advanced on behalf of both the parties.
In the X-Ray of chest radio opaque shadow of cylindrical shape was found and injury no.3 is only muscle deep. Looking to the nature of injuries, I consider it to be a fit case for bail.
Let the applicant Girjesh Rai indicted in case crime No. 86 of 2006 under sections 323, 325, 326, 504, 506 and 120-B I.P.C. P.S. Sikandarpur District Ballia , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
