Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the injuries were caused on the person of the deceased by using kicks and fists blows and iron rod, but according to the post mortem examination report the cause of death is asphyxia and no injury caused by iron rod was seen on his body. It is said that the applicant and co-accused Sunil Kumar were arrested by the police and on their pointing out the dead body of the deceased was recovered. Co-accused Sunil Kumar, whose case is on the same footing with the case of the applicant, has been released on bail by another bench of this court on 28.4.2006 in Criminal Misc Bail Application No. 4821 of 2006.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Guddoo involved in Case Crime No. 253 of 2005, under Sections 396 and 412 I.P.C., Police Station Billohar , District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
