This is an application for bail moved on behalf of the applicant Manoj Kumar indicted in case crime No. 1131 of 2006 under sections 406, 420, 467, 468, 471 I.P.C. P.S. Nai Mandi District Muzaffar Nagar.
Heard Shri G.P. Dixit , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that co-accused Pravin Kumar Sharma had assured the complainant to get him a job of doctor in Ayurvedic Department as number of vacancies were available at Ghaziabad, Bareiily and Moradabad. The learned counsel urged that co-accused Pravin Kumar Sharma made a false representation that he had links with people of high position. The learned counsel argued that the cheque of Rs. four lacs was returned by the accused Pravin Kumar Sharma and a subsequent complaint after dishonor of the said cheque was made against him.
The learned A.G.A. submitted that payment of Rs. four lacs was made to the applicant and co-accused. The learned counsel argued that applicant and co-accused had disclosed that they have joint finance company and co-accused Pravin Kumar Sharma has been authorised to operate its accounts.
I have taken into consideration the submissions advanced on behalf of both the parties.
The cheque of Rs. four lac was issued by the co-accused Pravin Kumar Sharma and after dishonor of cheque the criminal complaint was filed against him In view of these facts, I consider it to be a fit case for bail.
Let the applicant Manoj Kumar indicted in case crime No. 1131 of 2006 under sections 406, 420, 467, 468, 471 I.P.C. P.S. Nai Mandi District Muzaffar Nagar , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
