It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R., but during investigation the only evidence of last seen has been collected by the I.O. there is no other evidence against the applicant and the applicant was having no motive or intention to commit the alleged offence.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Munna involved in Case Crime No. Nil of 2006, under Sections 302 and 201 I.P.C., Police Station Gaur District Basti be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
