Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is delayed by one month without any plausible explanation. It was lodged on 14.4.2006 at about 6.30 p.m. in respect of the incident which had occurred on 14.3.2006 at 6.00 p.m. According to the post mortem examination report the deceased has received 2 injuries caused by hard and blunt object.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Nirju involved in case crime no. C-9 of 2006, under Sections 302 and 201 I.P.C. P.S. Mirzapur District Shahjahanpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
