This is an application for bail moved on behalf of the applicant Rajdev Singh indicted in case crime No.239 of 2006 under section 7/13 (2) Prevention of Corruption Act, 1988 P.S. Chandauli District Chandauli.
Heard Shri Amit Kumar Srivastava , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant is in jail for the last about two months. The learned counsel argued that the applicant is a sick person and is suffering from heart ailment, high blood pressure and blood sugar since the year 2000. The learned counsel urged that applicant was taken to District Hospital, Chandauli from jail after complaint of chest pain, blood pressure and blood sugar and was referred to S.S.P.G. Hospital Kabir Chaurah, Varanasi. The learned counsel submitted that the applicant was taken to Varanasi for treatment from jail and has been diagnosised as patient of engina.
The learned A.G.A. submitted that applicant was arrested at the spot and recovery of treated currency notes worth of Rs. 9,000/- was made from his possession.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is a government servant. He is in jail for the last about two months. The applicant is a sick person. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Rajdev Singh indicted in case crime No.239 of 2006 under section 7/13 (2) Prevention of Corruption Act, 1988 P.S. Chandauli District Chandauli, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
