Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant and other co-accused persons have been named only on the basis of doubt and suspicion. During investigation no direct eye witness account has been collected by the I.O. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Indrapal Devi involved in case crime no.263 of 2006 under Sections 302 I.P.C., P.S. Chhatari District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
