Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is the father in law of the deceased. The marriage of the deceased was solemnized six years prior of the alleged incident. The allegation against the applicant that the deceased was beaten by her in laws belies by the post mortem examination report because she has not received any ante mortem injuries. She was taken to the hospital where proper treatment was provided to her but unfortunately she died due to excessive bleedings. The case of the applicant is distinguishable with the case of the husband of the deceased.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jhadi Ram Chauhan involved in case crime no. 847 of 2006 under Sections 498-A,304-B I.P.C., and section ¾ D.P. Act P.S. Phoolpur District Varanasi be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
