Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation only evidence of extra judicial confession has been recorded after six months of the alleged incident. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Naresh involved in case crime no. 29 of 2006 under Sections 302,393 I.P.C., and 2/3 Gangster Act P.S. Aurangabad District Bulandshahar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
