This is an application for bail moved on behalf of the applicant Rais Ahamad   indicted in case crime No. 45  of 2006  under sections 379, 411  I.P.C. P.S. Gwaltoli  District Kanpur Nagar.

Heard Shri Vinod Kumar Srivastava, learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the applicant has been falsely implicated at the behest of the complainant Framud Ali Pundir  S.H.O.  P.S. Anwarganj who happens to be the real uncle of the applicant's wife. The learned counsel argued that applicant and complainant's niece married  without permission of their family. The learned counsel urged that there is no previous criminal history of the applicant.

The learned A.G.A. submitted that recovery of eight stolen cars was made from the possession and in pursuance of the disclosure statement of the applicant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The recovery of car involved in the present case was made in pursuance of the disclosure statement of the applicant and co-accused. The applicant is in jail for the last about five months. The offences are triable by the Magistrate Ist class. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Rais Ahamad   indicted in case crime No. 45 of 2006 under sections 379, 411 I.P.C. P.S. Gwaltoli District Kanpur Nagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
