This is an  application for bail moved on behalf of the applicant Zafar Khan   indicted in case crime No. 355  of 2006  under sections 41, 411, 467, 468, 471, 419, 420  I.P.C. P.S. Kotwali Nagar  District Banda.

Heard Shri W.H. Khan , learned counsel for the applicant, learned A.G.A.  and have perused the record.

The learned counsel for the applicant submitted that the recovered car has not been connected with any case of theft. The learned counsel argued that there is no previous criminal history of the applicant. According to the learned counsel the applicant has been falsely implicated in the present case at the behest of  Shyam Mohan Dhuriya a well known criminal. The learned counsel urged that applicant has been enlarged on bail by the Delhi court in the case of theft of car which is said to have been recovered from the applicant's possession.

The learned A.G.A. argued that recovery of four stolen cars was made from the possession and at the pointing out of the applicant.

I have taken into consideration the submissions advanced on behalf of both the parties.

The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about four months. The recovered vehicles have not been connected with any offence. In view of these facts, I consider it to be a fit case for bail.  

Let the applicant Zafar Khan   indicted in case crime No. 355  of 2006  under sections 41, 411, 467, 468, 471, 419, 420  I.P.C. P.S. Kotwali Nagar  District Banda, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
