This is an appeal against an interim order dated 13.11.2006 passed by the learned Single Judge in the writ petition filed by respondent no.4.

The writ petition was filed against a letter dated 06.07.2006, by which the signatures of the appellant were attested as Officiating Principal on the retirement of Pratap Singh on 30.6.2006.

By an order of the date passed by us in Special Appeal No.1594 of 2006: Raj Veer Singh Vs. The Regional Joint Director of Education, Agra Region, Agra and others, filed by the appellant, we have set aside the order of the learned Single Judge dismissing the writ petition No.43842 of 2001 of the appellant on the ground that the status of the appellant was only of an ad hoc Lecturer. The interim order dated 13.11.2006, which is under challenge in the present appeal, has been passed on the same ground and reasoning.

For the reasons given by us in our order of the date passed in Special Appeal No.1594 of 2006, the interim order dated 13.11.2006 is set aside. However, it will be open for the parties to pray for any further order in the first Court. Our order and observations are without prejudice to the rights and contentions of either of the parties.

The appeal is allowed accordingly.
