Dr. Virendra Prtap v. Chairman, Public Service Commission, U.P. And Another - WRIT - A No. 70484 of 2006 RD-AH 21648 (22 December 2006)
HON. R.P. MISRA, J.
HON.SHISHIR KUMAR, J.
Heard learned counsel for the petitioner Sri Anil Kumar Srivastava and the learned Counsel for the respondents Sri Pushpendra Singh.
The form of the petitioner has not been accepted merely on the ground that it was not signed by the petitioner. It has been submitted by the learned counsel for the respondent Sri Pushpendra Singh that this cannot be allowed in view of the advertisement. However, in our view the objection raised by the learned counsel for the respondent cannot be accepted.
In these circumstances a mandamus is issued to the respondent no.2, Secretary, Public Service Commission U.P. Allahabad to accept the form of the petitioner if there is only the mistake of not signing the form by the petitioner.
With the aforesaid directions the writ petition is disposed of.
