Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the name of the applicant has been disclosed by the co-accused Deepak Mishra. At the pointing out of the applicant, co-accused Deepak Mishra and the co-accused Shiv Singh, cloths, shows and the wrist watch of the deceased has been recovered. The recovery is not supported by any independent witness and the applicant is not having any criminal antecedent The co-accused Deepak Mishra whose case was on the same footing as the applicant has been released on bail by this court on 19.10.2006 in criminal misc. bail application no. 22631 of 2006
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Mohammad Nazar alias Guddu involved in case crime no. 985of 2006(S.T. No. 103 of 2006) under Sections 364,365,395,302,201 I.P.C., P.S. Kotwali Farrukhabad District Farrukhabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
