Hakim Singh v. State Of U.P. And Others - WRIT - C No. 6115 of 2006 RD-AH 2345 (31 January 2006)
Hon'ble Yatindra Singh,J.
This is a writ petition against orders dated 6.2.2005 and 4.4.2005 cancelling the petitioner's licence for fair price shop.
We have heard counsel for the petitioner and the Standing counsel for the respondents.
The counsel for the petitioner submits that no opportunity was given to the petitioner before cancelling his licence.
This order was passed about one year before. In the circumstances of the case, it will be appropriate that the petitioner may file fresh representation before respondent no. 3. In case the representation is filed, the same may be decided by the said respondent by a reasoned order at an early date, if possible, within three months from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self addressed envelope along with the representation. The concerned authority after taking decision will communicate the same to the petitioner.
With these observations the writ petition is disposed of.
