Shri Rajnath Shukla, learned counsel appearing for the Official Liquidator has filed OL report stating that the notices were published in Form-63 under Rule 148 (1) of the Companies (Court) Rules 1959 inviting applications in four news papers on or before 20.1.2005. The claims are awaited.
This is a creditor's winding up petition to wind up M/s PremierVinyl Flooring Ltd. In Company Petition No. 66 of 1999, this Court, after issuing citation and having no response from the company, found that the respondent-company is unable to pay its debt. The respondent-company was wound up on 13.3.2003 and is in liquidation. The plant and machinery was sold on 6.11.2003 and the sale was confirmed on 1.5.2004. This Court is in the process of inviting claims for settlement under Rule 148 of the Companies (Court) Rules 1959. The notices have been published in four newspapers and according to Official Liquidator's report, he is watching the claims for adjudication.
The winding up order passed in favour of any creditor enures to the benefit of all the creditors. No fresh order of winding up is required to be made. The company petition is accordingly disposed of. In case the petitioner-creditor desires, they may make their claims before the Official Liquidator within the period prescribed under the Companies (Court) Rules 1959.
