Kumar Archana v. State of U.P. and others - WRIT - B No. 5715 of 2006 RD-AH 2368 (31 January 2006)
Hon'ble Vineet Saran, J
By means of this writ petition the petitioner is claiming the benefit of the Government Order dated 12.9.2005 with regard to the payment of Kanya Vidya Dhan. The contention is that the petitioner fulfills all the conditions provided for in the said Government Order and thus she would be entitled to the said benefit of payment of Kanya Vidya Dhan, which is not being given to her. In this regard, the petitioner has already filed several representations before the District Magistrate, Ballia, respondent no.2, which have yet not been decided.
Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is finally disposed of with a direction that in case if, with regard to her grievances made in this writ petition, the petitioner files a fresh comprehensive representative before the District Magistrate, Ballia, respondent no.2 alongwith a certified copy of this order, the same shall be considered and decided by him, in accordance with law, by a speaking order after giving opportunity of hearing to the petitioner and other concerned parties, if there be any, as expeditiously as possible, preferably within a period of two moths from the date of filing of the same.
With the aforesaid observations/directions, this writ petition is finally disposed of.
