The petitioner's fair price shop licence was suspended on 28.9.2005. The petitioner challenged that order in WP No.  76556 of 2005. The respondents were granted time and thereafter this court by interim order dated 16.12.2005  stayed the suspension order dated 28.9.2005. According to the petitioner after the interim order was granted by this court, the respondent in order to overreach the interim order passed the impugned order on 18.12.2005 which was Sunday and cancelled the licence of the petitioner.

Issue notice.

Notices on behalf of respondents have been accepted by the Standing counsel. He prays and is granted three week's time to file counter affidavit. Two weeks' time thereafter is granted for rejoinder affidavit. List both the petitions after expiry of the aforesaid period.

Till the next date of listing, operation of order dated 18.12.2005 shall remain stayed.
