The petitioner claims to have moved an application before the Divisional Forest Officer, Mathura for grant of licence to run the Saw Mill but as the licence was not granted, this petition has been filed for a direction to the respondents to decide the matter relating to grant of licence to the Saw Mill.
We have heard learned counsel for the petitioner and learned Standing Counsel appearing for the respondents.
We had decided a similar controversy in Writ Petition No.47307 of 2005, Chaudhary Chandan Singh Vs. State of U.P. & Ors., vide judgment and order dated 5.7.2005 and we are of the considered opinion that the application filed by the petitioner should be decided in the light of the observations made in the aforesaid judgment.
We, accordingly, dispose of this petition by directing the authority concerned to decide the application in the light of the observations made in the Writ Petition No. 47307 of 2005, Chaudhary Chandan Singh Vs. State of U.P. & Ors. decided on 5.7.2005.
