Election petition has been filed by the petitioner in October 2005. Notices have to be served. Evidence of both the parties including written statement has to take place. In the circumstances it is not possible to direct the respondent to decide finally the election petition before February 2006 when the next election has to take place. The direction sought by the prayer no.2 for ordering recounting is also not possible because recounting cannot be ordered as in routine as law laid down by the Supreme Court.
In the circumstances this writ petition is disposed of directing the respondent no.2 not to allow the returned candidate to take undue or unduly long adjournment and thereby delayed the matter.
Writ petition is disposed of.
