The prosecution has filed counter affidavit. Keep it on record.
The learned counsel for the applicant submits that he has already filed rejoinder affidavit on 13.12.2005. Sri S.P.Tiwari, learned counsel for the complainant submits that no copy of the rejoinder affidavit has been given to him and he has to rebut the allegations made in it. It was also submitted that the applicant has filed some documents along with this rejoinder affidavit which was not confined to the counter affidavit but he has given cross version of the case in the copy of the complaint filed by him as R.A.2 and so he should be provided an opportunity to rebut the same.
The counsel for the complainant is allowed ten days' time to file his supplementary counter affidavit as prayed. List the case for hearing in the week commencing 13.2.2006.
