The petitioner prays that her representation should be decided by the Sub-Registrar. It has not been shown to us as to how the Sub-Registrar can cancel the registration of a document or a marriage certificate. Such power, prima facie, does not exist either with the Sub-Registrar or with Marriage Officer. Therefore, the relief sought in the representation cannot be granted by these officers.
This Court cannot accept the argument of the learned counsel for the petitioner that in the changed situations, the Sub-Registrar should have such power because it is not open to this Court to legislate under Article 226 of the Constitution of India.
Writ petition being misconceived is dismissed.
