Heard learned Counsel for the applicant, learned A.G.A. and Sri G.P.S. Raghav and B.K. Yadav learned counsel for the complainant.
It is submitted by learned counsel for the applicant that according to medical examination report the age of the prosecutrix is above 19 years. No injury was seen on her person and no definite opinion about rape could be given. She was having love affairs with the applicant and she was a consenting party.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Mahesh involved in Case Crime No. 100 of 2005, under Sections 376 and 342 I.P.C., Police Station Madrak, District Aligarh be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
