The date chart in the petition shows that the respondent No.4 had been put under suspension whereas the averments made in the petition are different. The petitioner claims that there is a resolution of the Gram Panchayat in his favour as the earlier license holder is facing an enquiry and his licence has been put under suspension. It has to be seen as to whether the said licensee had ever approached any Appellate Authority against the said suspension order and whether the enquiry was concluded and if he had approached the Appellate Authority, any interim order was granted in his favour. In the absence of such material no relief can be granted to the petitioner.
The writ petition is, accordingly, dismissed.
