Heard Sri Siddhartha Varma, learned counsel for the accused applicant, learned A.G.A. and perused the record.
Accused Om Prakash Pandey son of Sri Ram Pandey has prayed for release on bail in case Crime No. 43 of 2005 under Sections 381, 411 IPC, P.S. G.R.P. Manikpur, District Chitrakoot.
Prosecution case is that when the informant was travelling in train he left his purse in the toilet and thereafter came back to his seat. Subsequently he returned, he enquired from the accused applicant who was working as Attendant in the coach and he gave Rs. 2500/- to the applicant and also told him that he has thrown his mobile and credit card.
Learned counsel for the accused applicant has contended that applicant is neither servant nor the master and no offence under Section 381 IPC is made out and no recovery has been made from the applicant and applicant has been falsely implicated in this case and that he is in jail for about a month.
In the circumstances, but without prejudice to the merits of the case, accused is entitled to bail.
Let the accused named above be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
