Heard Sri Santosh Srivastava and Karuna Srivasta, learned counsel for the accused applicant, learned A.G.A. and perused the record.
Accused Abdul Hakim son of Late Shri Abdul Kayyum has prayed for release on bail in case Crime No. 401 of 2005, under Sections 379, 411 IPC, P.S. Sadar Bazar, District Meerut.
Accused is alleged to have been found in possession of stolen motorcycle on 13.10.2005.
The contention of the learned counsel for the applicant is that he has been falsely implicated in this case and he was lifted from his house in the night of 10/11-10-2005 and in that connection the application was also given in the office of Sr. Supdt. Of Police, Meerut which was duly received there.
In the circumstances of the case, but without prejudice to the merits of the case, accused is entitled to bail.
Let the accused named above be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
