Sri Wasim Alam, learned Standing Counsel appearing for the respondents states that paragraph 20 of the counter affidavit was got prepared on the basis of the narrative dated 12.1.2006 sent by Sri S.R.Meena, Inspector General (Registration), U.P. camp, Lucknow. From the records, we do not find that the entry awarded to the petitioner on 30.10.1996 was served on him nor there is any material on record to show that service was effected by the District Registrar, Saharanpur. The narrative on the basis of which affidavit has been sworn appears to be false and it amounts to making an effort to mis-lead the court and play fraud on it.
Therefore, we direct that Sri S.R.Meena, Inspector General (Registration), U.P. camp- Lucknow shall appear before the court on 17.2.2006 to show cause as to why he may not be punished for furnishing false material to the person who had sworn the counter affidavit in this case. A copy of the narrative sent by Inspector General (Registration) be kept on record in sealed cover, which shall be treated to be part of the record.
List this petition on 17.2.2006 for further hearing.
Let a copy of this order be handed over to Sri Wasim Alam, learned standing counsel for information and compliance of this order, within 24 hours.
