HIGH COURT OF JUDICATURE OF ALLAHABAD

Hon. Tarun Agarwala,J.

Initially an interim order was passed restraining the opposite parties from ejecting the applicant from the property in question. Subsequently, the writ petition was allowed and the opposite parties  were restrained from dispossessing the applicant. It transpires that after 10 years an order was passed for evicting the applicant and on that basis the applicant was evicted. In the opinion of the Court, the eviction of the applicant is  a subsequent cause of action and has noting to do in so far as the earlier judgment is concerned.

Consequently, the contempt proceedings are dropped, the notices are discharged and the contempt application is rejected.
