Heard Sri Shashi Bhushan learned counsel for the petitioner, Sri Shivasare Saroj for next of kins.

This application for Letters of Administration of the property and credits of Late Paras Nath Yadav son of Late Ram Bharos resident of 62C/1, Rajapur, Allahabad filed by his widow Smt. Shanti Devi, Sri Paras Nath Yadav died on 24.7.2005 at Allahabad.  The death certificate has been annexed as paper No. A-3/9.

It is stated that the deceased has left behind (i) Rs.2,58,450.16 in Saving Bank Account No. 01190002183 State Bank of India, Allahabad (ii) Rs. 1,14,295.00 Gterm Deposit TD 0131360, State Bank of India, Allahabad (iii) Rs. 1,07,482.00 in Term Deposit, TD 1031292, State Bank of India, Allahabad.  All the three accounts totals to an amount of Rs. 4,80,227.16.

Notices were issued to next of kins on 5.12.2005.

The Registrar General has given certificate under Chapter XXX Rule 8 of the Rules of the Court. The citation has been published in daily newspapers ' Amar Ujala' and 'Northerin India Patrika' dated 26.12.2005, the copies of which have been placed on record by way of supplementary affidavit.  All the five next of kins namely Jai Prakash Yadav, Om Prakash Yadav, Smt. Priyanka Yadav, Smt. Pushpa Yadav and


Smt. Usha Yadav have filed their  no objection for grant of Letters of Administration to their mother Smt. Shanti Devi.  

The matter is thus con-contentious.

The testamentary case is allowed.  Let Letters of Administration be issued to the applicant Smt. Shanti  Devi on payment of required Court fee to be determined by the office within two weeks. After issuance of the certificate by the Registrar General with regard to sufficiency and payment of court fees,  and execution of Administration Bond the Letters of Administration shall be issued to the applicant to operate the accounts detailed as above.  She shall   submit the accounts to the court in accordance with Rules of the Court.
