According to the report of the Chief Medical Officer, Allahabad, the girl, petitioner no. 1, Pooja has been medically examined and her age is reported to be between 16 and 18 years. Thus, she cannot be said to be above 18 years. There is no other proof of age to the contrary. In view of the above medical report of age, there is no question of any volition  on part of the lady with regard to her alleged marriage to the petitioner no. 2.

Writ petition is accordingly dismissed. The report of the C.M.O., which has been submitted by the learned Standing Counsel shall be retained on record.
