Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version 3 cases are shown in the gang chart against the applicant out of which he has been released on bail in two cases and in remaining 3rd case i.e. Case crime no. 51 of 2005, under Section 364-A I.P.C. , P.S. Kotwali Nagar, district Etah he has applied for bail. The applicant is in jail since 06.07.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sarvesh involved in Case Crime No. 327 of 2005, under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act, Police Station Kotwali Nagar, District Etah be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
