As per the F.I.R. only allegation against the petitioner  is that out of Rs.9480/- he is only utilized Rs.2281/- and the rest amount i.e. Rs.7199/- has been allegedly misappropriated. Allegations against the others are different and more serious in nature. So far as the petitioner is concerned except above, we do not find any other allegation. He is ready and willing to deposit such sum. Subject to deposit of  Rs.7199/- within fortnight from this date by the petitioner with the appropriate authority, the following order is passed.

The Investigating Officer will complete the investigation of Case Crime No.03 of  2006, under Sections 406,409 I.P.C., P.S.   Shahabad, District Rampur within a period of three months from the date, on which a certified copy of this order is presented before him. The petitioner/s  is/are directed  to co-operate with the Investigating Officer in all possible manner. If  the Investigating  Officer  or  informant found  himself  aggrieved  due  to  falsification, misstatement, fraud,  non-cooperation  with the Investigating Officer or any other  reasons whatsoever  relevant  for  the  purpose,  they are at liberty to apply for recalling/variation/vacating/modification of the order.

However, the petitioner/s  will not  be  arrested in the aforesaid case crime number till the submission of chargesheet, if any.

Accordingly, the writ petition stands disposed of.

However, no order is passed as to costs.

Petitioner will be entitled to have the following orders till the filing of chargesheet .
