Heard learned counsel for the petitioner.

This writ petition has been filed against the notice, issued by learned Magistrate, under Section 421(1)(a) Cr.P.C. Which is appealable under Section 449 Cr.P.C.

Learned counsel for the petitioner does not wants to press this writ petition and he requested that he may be given liberty to file appeal. It is open for the petitioner to choose legal remedy as provided under the provisions of Cr.P.C.

In light of above, the writ petition is dismissed as not pressed.

Certified copy of the impugned order challenged in the writ petition may be returned to the petitioner.
