This writ petition has been filed for a direction upon the respondents to enter the name of the petitioner in Revenue records as Bhoomidhar with non-transferable rights in respect of the plot in dispute in compliance of the order dated 27th February 2004 passed by the Assistant Collector 1st Class/ Sub-Divisional Magistrate, Hapur.
We have heard learned counsel for the petitioner and the learned standing counsel appearing the for the respondents.
Learned counsel for the petitioner has made a categorical statement in view of the averments made in paragraph 16 of the writ petition that no appeal or revision has been filed against the aforesaid order dated 27.2.2004. He has further stated that an application has been filed by the petitioner on 27th July 2005 before the Sub-Divisional Magistrate and a copy of the same has been annexed as Annexure-3 to the petition and even though substantial time has lapsed after filing of the application, no orders have been passed.
Learned standing counsel, however, submits that the Sub-Divisional Magistrate shall pass appropriate orders on the application filed by the petitioner expeditiously.
In view of the aforesaid statement of the learned standing counsel, we dispose of this petition with a direction to the Sub-Divisional Magistrate to decide the pending application dated 27th July 2005 expeditiously in accordance with law, preferably within a period of six seeks from the date of filing of this order after hearing the parties concerned.
