There are two issues in this writ petition. The first is that wherein the petitioner wants to restrain the respondent no. 5 from running a parallel organization. If the petitioner has any such right, the same may be enforced through a civil suit.
The second issue is regarding taking out of a shobha yatra in the city of Rampur by the respondent no. 5 also. According to the petitioner, this would give rise to law and order problem in the city. For this purpose, the petitioner is permitted to make a representation to the District Magistrate, who will examine the rival submissions of the petitioner and the respondent no. 5 with regard to the shobha yatra only and after giving opportunity of hearing to both, the District Magistrate will take such decision as may be necessary for maintaining peace and for avoiding any law and order problem by a reasoned order within six weeks of the date of which the representation is made by the petitioner along with certified copy of this order before the District Magistrate.
The writ petition is disposed of as above.
